  • Manage and organize your transaction data

MyBankScan is operated by an individual and provided as an online-only service. We reserve the right to modify, suspend, or discontinue any aspect of the service at any time.

3. User Accounts and Registration

3.1 Account Creation

To use MyBankScan, you must create an account by providing:

  • A valid email address
  • Your name
  • A secure password

You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account

We are not liable for any loss or damage arising from your failure to maintain account security.

  • Create multiple accounts for the same individual
  • Share your account credentials with others
  • Transfer or sell your account to another person

4. Intellectual Property Rights

MyBankScan and all related software, technology, trademarks, logos, and content (excluding user-generated content) are owned by us or our licensors. This includes:

  • The MyBankScan website and application
  • All design elements, graphics, and user interfaces
  • Our proprietary algorithms and categorization systems (subject to third-party AI services)
  • All documentation and content we provide

These Terms do not grant you any right, title, or interest in our intellectual property except as expressly stated for use of the service.

4.2 Your Data

You retain all ownership rights to your transaction data and any content you upload to MyBankScan. By using our service, you grant us a limited license to:

  • Process your data to provide the services you've requested
  • Store your transaction data on our secure servers
  • Use anonymized, aggregated data for service improvement (with no personally identifiable information)

This license terminates when you delete your data or close your account.

5. Service Availability and Modifications

5.1 Service Availability

We strive to maintain high service availability, but we do not guarantee uninterrupted access to MyBankScan. The service may be unavailable due to:

  • Scheduled maintenance
  • Technical difficulties or system failures
  • Circumstances beyond our reasonable control
  • Security or safety concerns

We reserve the right to:

  • Modify, update, or discontinue features of the service
  • Change pricing structures for current or future premium features

  • Free tier features will remain available to non-paying users
  • Payment processing will be handled securely through Stripe
  • Separate terms may apply to paid subscriptions

When paid features are introduced, our refund policy will be clearly stated at the time of purchase. Unless otherwise required by law, all sales will be final once services are delivered.

7. Acceptable Use and Prohibited Conduct

You agree not to use MyBankScan to:

  • Violate any applicable laws, regulations, or third-party rights
  • Upload malicious code, viruses, or any harmful software
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with or disrupt the service or servers
  • Use automated systems (bots, scrapers) without our express written permission
  • Reverse engineer, decompile, or attempt to extract source code
  • Upload data that you do not have the right to process
  • Use the service for any fraudulent or illegal activity

7.2 Enforcement

We reserve the right to investigate violations of these Terms and take appropriate action, including:

  • Removing content that violates these Terms
  • Suspending or terminating accounts
  • Reporting illegal activity to law enforcement
  • Taking legal action against violators

8. Data Processing and Privacy

Your use of MyBankScan is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

Key points regarding data processing:

  • PDF files are never stored: We process your bank statement PDFs in memory only and never save them to disk
  • Transaction data storage: Extracted transaction information is stored securely in your private account
  • Third-party processing: Transaction data may be processed by OpenAI for AI-powered categorization
  • Your control: You can delete your data at any time

9. Disclaimers and Warranties

9.1 'As Is' Basis

MyBankScan is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to:

  • Warranties of merchantability or fitness for a particular purpose

  • Warranties of uninterrupted or error-free service

9.2 Financial Advice Disclaimer

MyBankScan is NOT a financial advisor and does not provide financial, investment, tax, or legal advice.

  • Any insights or categorizations are automated and for informational purposes only
  • You should consult qualified professionals for financial advice
  • We are not responsible for any financial decisions you make based on data from our service

9.3 Accuracy of Data

While we strive for accuracy in processing your bank statements:

  • We do not guarantee the accuracy of extracted transaction data
  • AI-powered categorization may contain errors
  • You are responsible for verifying the accuracy of your data
  • We are not liable for any errors or omissions in data processing

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • MyBankScan and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages
  • This includes damages for loss of profits, data, use, goodwill, or other intangible losses
  • Our total liability for any claims arising from your use of the service shall not exceed the amount you have paid us in the 12 months preceding the claim (or AUD $100 if you have not made any payments)
  • These limitations apply regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise)

Some jurisdictions do not allow the limitation of certain damages, so some of these limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless MyBankScan and its operator from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use or misuse of the service
  • Your violation of these Terms
  • Your violation of any rights of third parties
  • Your violation of any applicable laws or regulations
  • Any data you upload to the service

12. Termination

12.1 Termination by You

You may terminate your account at any time by:

  • Deleting your account through account settings, or

Upon termination, all your personal data and transaction information will be permanently deleted from our systems.

12.2 Termination by Us

We reserve the right to suspend or terminate your access to MyBankScan at any time, with or without notice, for:

  • Violation of these Terms
  • Fraudulent, abusive, or illegal activity
  • Extended periods of inactivity
  • Technical or security reasons
  • Discontinuation of the service

12.3 Effect of Termination

Upon termination:

  • Your right to access the service immediately ceases
  • Provisions of these Terms that by their nature should survive (including disclaimers, limitations of liability, and indemnification) will remain in effect
  • If you have paid for premium features, refunds (if any) will be handled according to our refund policy

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Australia, without regard to conflict of law principles.

Any disputes arising from or relating to these Terms or your use of MyBankScan shall be subject to the exclusive jurisdiction of the courts of Australia.

If you are accessing MyBankScan from outside Australia, you are responsible for compliance with local laws in your jurisdiction.

14. Dispute Resolution

14.1 Informal Resolution

Before pursuing formal legal action, we encourage you to contact us at mybankscan@gmail.com to resolve any disputes informally. We commit to working with you in good faith to reach a fair resolution.

14.2 Arbitration

If informal resolution is unsuccessful, disputes may be resolved through binding arbitration in accordance with Australian arbitration laws, rather than through court proceedings.

14.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted on an individual basis and not as part of a class, consolidated, or representative action.

15. Severability and Waiver

15.1 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

15.2 Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision. Any waiver must be in writing and signed by us to be effective.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make changes:

  • For material changes, we will notify you via email or through a prominent notice on our service at least 30 days before the changes take effect
  • Your continued use of MyBankScan after changes take effect constitutes acceptance of the updated Terms
  • If you do not agree to the updated Terms, you must stop using the service and may delete your account

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MyBankScan regarding your use of the service. They supersede all prior agreements, understandings, and communications, whether written or oral.
